PROCESS

First, your Bankruptcy is filed as a Chapter 11 or 13. Under Chapter 7 you cannot lien strip. Your bankruptcy plan will disclose that you intend to file and serve a motion or an adversary proceeding to avoid the second, third or fourth mortgage of the lender.

Second, we have to have your real property valued by using a licensed real estate appraiser which then sends us the appraisal report. The main requirement: so long as the value of your real property is less than the principal balance of your first mortgage, you may qualify to strip off your second, third or four mortgage(s), and treat that subject mortgage as if it were an unsecured credit card.
